Copyright Infringement Policy (DMCA Notice & Takedown Procedure)
Cultpix respects the intellectual property rights of creators, copyright holders, and content partners, and we expect our users and members to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”) and other applicable copyright laws, Cultpix has adopted the following policy regarding claims of copyright infringement.
Reporting Copyright Infringement
If you believe that material available on the Cultpix website or services infringes your copyright, you may notify our Designated Copyright Agent by providing a written notice that includes the following information (as required under 17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with enough detail for us to locate it (e.g., URL).
- Your contact information, including your full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

Counter-Notification
If you believe that your material has been removed (or access to it disabled) as a result of a mistake or misidentification, you may submit a counter-notification to our Copyright Agent. The counter-notification must include:
- Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court in your judicial district (or, if outside the United States, to the jurisdiction of the U.S. District Court for the Southern District of New York), and that you will accept service of process from the person who provided the original infringement notification or their agent.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, Cultpix may restore the removed material in accordance with the DMCA, unless the copyright owner files an action seeking a court order against you.
Repeat Infringers
Cultpix reserves the right to terminate the accounts of users who are found to be repeat infringers.
Reservation of Rights
Cultpix also reserves the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability to you.
